The Supreme Constitutional Court in Benghazi issued a major ruling on Monday, announcing the abolition of the Constitutional Chamber of the Supreme Court of Cassation, under Decision No. 7 of 2025. The move marks a significant restructuring of Libya’s judicial system and consolidates constitutional authority under the newly formed court in Benghazi.
According to the decision, the Constitutional Chamber that previously operated within the Supreme Court of Cassation has been dissolved. All cases and petitions that fall under the jurisdiction of the Supreme Constitutional Court will be transferred directly to it, without any fees or additional procedures.
The ruling grants litigants involved in ongoing constitutional cases before the former chamber the right to refile their cases within three months from the date of the decision, also free of charge. However, any appeals not refiled within that period will be considered void.
The decision further states that it takes effect immediately upon issuance and will be published in the Official Gazette and other media outlets to ensure transparency and public awareness.
On June 10, 2025, the House of Representatives issued Decision No. 2, appointing Counselor Mustafa Abdullah Mohamed as President of the Supreme Constitutional Court, headquartered in Benghazi.
